Title (other): Voter attendance and significance to the Polish electorate and political landscape
Abstract
Polish politicians are increasingly often referring to the prospect of next year's elections to the European Parliament. Voters, however, are still unaware of the fact that these elections are to take place. Only 27% of Poles know that they will be choosing their representatives to the European Parliament in general elections. The European Parliament plays only a minor role in the present institutional makeup of the European Union. Elections to the European Parliament do not entail any obvious political consequences. As a result, the significance of these elections to Western European politicians and voters is only secondary to national parliamentary elections. As a rule, they only play the role of a 'barometer' of the national political landscape, providing information on voter preferences that may later be used in national elections. Therefore, low voter turnout can be primarily attributed to the absence of political consequences of European elections, rather than to the rejection of the European integration ideal. Studies conducted with reference to current EU member states suggest that the following factors promote higher voter turnout in elections to the European Parliament: compulsory voting, concurrent national parliamentary elections, perceived weakness of domestic institutions and overall support for the country's membership of the EU. In Poland, owing to a very low assessment of domestic institutions and hopes placed in democratic institutions of the EU, as well as the fact that elections to the European Parliament will be an interesting novelty to Polish voters, one may expect a relatively high turnout. If European and national parliamentary elections are held at the same time, then even the opposite of the situation in Western Europe may occur: elections to the European Parliament might 'prop up' voter turnout at national parliamentary elections. Title: The use of shareholder voting rights during the general assembly of company shareholders
Abstract
Some financial products facilitate (“Financial Instruments”’) the use of voting rights that can be considered questionable under the law (“Questionable Uses of Voting Rights”). These Questionable Uses of Voting Rights become apparent when, using the Financial Instruments, an investor is in a negative voting situation. This situation occurs when an investor, being indifferent to the impact of his vote for the company (“Empty Voter”), uses his vote to implement a conflict of interest, sometimes by voting against the company interest. These Questionable Uses of Voting Rights also become apparent in the case of a hidden shareholding situation. This is where an investor is able to direct the vote on shares in a company without officially being a shareholder. Questionable Uses of Voting Rights highlight legally reprehensible conducts such as fraud and abuses of rights and power. To avoid Questionable Uses of Voting Rights, a number of measures can be taken. These include compulsory disclosure and limitations on voting rights. [European Parliament]

Title: Independent Candidates in National and European Elections
Abstract
Independent candidates remain marginal vote-getters in the vast majority of elections in which they compete. However, they do regularly win seats in legislative assemblies in a number of European countries, and occasionally achieve surprise victories in others. Half of the EU member states currently grant ballot access to independents in national legislative elections, while only a quarter of member states allow non-party candidates in European Parliament elections. Ballot access requirements for independents vary widely across EU-27 but tend to be more stringent for European elections than for national elections. Independent candidates perform better in systems with plurality rule or preferential voting compared to party-list PR systems. They win seats in single-member districts and low-magnitude multi-member districts. Although independents are expected to benefit from electoral rules that make politics more candidate-centered, the performance of non-party candidates does not depend on the modality of lists (open or closed). The vote for independents has elements of a protest vote. Voters who vote for independent candidates tend to be more critical of the government and less satisfied with the way democracy works in their country than party-voters. They are also less likely to feel close to any political party. When independent candidates are elected to office, they frequently join parties and parliamentary party groups. Thus, independence is often not a principled position but a temporary status resulting from circumstantial choices made by individuals competing for political office.
