According to the ArbVG, collective agreements can be concluded only between collective organisations of employers and employees. Over 90% of employees are covered by a collective agreement, placing Belgium among the countries with the highest coverage in Europe. Abstract The right to collective bargaining is set out in the 1972 French Labour Code. In the last decades, collective bargaining has expanded, partly as a result of government initiatives. The importance of sectoral bargaining increased with the adoption of the 1982 Auroux laws, which obliged the bargaining parties already bound by a sectoral agreement to negotiate pay annually and to discuss the sectors job classification system and its economic development every five years. The Auroux laws also stimulated company-level bargaining by making annual negotiations on pay and working time obligatory in companies with union representation. [Eurofound] |

Abstract The right to collective bargaining and the binding character of collective agreements is enshrined in the Spanish Constitution (Section 37.1). The system of collective bargaining is thoroughly regulated in Title III of the Workers Statute. In particular, Section 82.3 establishes the legally binding character of collective agreements negotiated in conformity with the rules of the Workers Statute. Title: Managed vs free wage-setting in Finland and Estonia: optimising outcomes |

Abstract Wage-setting systems are a key element of the labour market institutional setup. In Europe, they vary considerably, reflecting the diversity of existing economic and social models. Over the long run, different wage-setting models can have a significant impact on macroeconomic performance, industrial structure, and social cohesion. The Finnish and Estonian wage-setting systems are an example of a stark contrast between close neighbours. In Finland, wage-setting is highly centralised and in Estonia it is almost fully decentralised. While each of these systems appears to have supported a good overall performance in terms of employment and economic activity in these countries, each has given rise to serious challenges in some other areas. Estonia needs to cope with the pro-cyclical volatility of its wage growth, which risks feeding through to higher inflation, and with social equity issues. Conversely, Finnish wage-setting prevents its companies from reacting flexibly to changing markets. Both Estonia and Finland may need to consider how these current drawbacks could be addressed without compromising the credibility and overall positive performance of their wage-setting systems. |
