Abstract
Strukturen der allgemeinen und beruflichen Bildung und der Erwachsenenbildung in Europa Wer die allgemeine Organisation der Bildungssysteme in Europa kennen lernen möchte, findet die entsprechende Basisinformation in den ca. 40-Seiten umfassenden Länderberichten. Diese Monografien werden regelmässig überarbeitet und auf den neuesten Stand gebracht. Aufgrund ihrer einheitlichen Struktur, erleichtern sie Vergleiche zwischen den einzelnen Staaten. Behandelt werden die verschiedenen Bildungssysteme, vom Vorschul- bis zum Hochschulbereich, die Erwachsenenbildung sowie die berufliche Bildung im Schulwesen als auch im dualen System. Für jedes Niveau findet man kurz gefasste Informationen, insbesondere über Zugangsvoraussetzungen, Ausbildungsdauer, Lehrpläne, Evaluationsansätze und Ausbildung der Lehrer. Title: Labour Market Policy: Qualitative Reports - Germany 2001
Abstract
The Qualitative Reports of the Labour Market Policy (LMP) database give a succinct description of each one of the labour market policy measures included in the database. All reports - one for each country - have the same structure: Part A includes the Inventory of measures, i.e. the list of all measures regrouped by category. Part B presents each measure in three main sections: Identification, Description, and Supplementary information. The three sections contain the most relevant information concerning each measure. The Descriptions contain seven sub-sections: Aim, Beneficiaries, Action/Instrument, Financing/Support, Eligibility, Legal basis, and Recent changes. The Supplementary Information contains information concerning the target groups, the conditions for participation and other characteristics of the measure. The qualitative reports allow the user to understand what hides behind the figures on expenditure and participants collected in the LMP database, and therefore should be considered as complementary information to the publication 'Labour Market Policy - Expenditure and Participants - Detailed Tables'. Title: A driving force despite everything : Franco-German relations and the Enlarged European Union

Abstract
The analysis of the three fundamental documents of Franco-German co-operation enables us to make a sketch of three scenarios which seem to show the major directions of common action during the past years. Firstly, Franco-German actions are motivated by different national interests and traditions. This divergence of interests may result in constructive common European policies under the condition that both partners share a joint goal for their political and economic projects. In this case, they are capable of drawing up 'compromises by proxy' and of obtaining the support of most of the other member states. In the history of European integration, this has been the case for the implementation of the European Coal and Steel Community as well as of the Monetary Union. But the French-German initiative for ESDP at the European Convention had received a large majority and only failed due to the determined resistance of the United Kingdom. This counter-example and the outcome of the Franco-German propositions in economic and monetary policy - which were hardly constructive - underline the importance of a common vision. Secondly, Paris and Berlin pursue a policy based on converging - if not identical - interests without, however, feeling the necessity to formulate compromises by proxy. The example of the Iraq crisis has shown the risk both countries run in case they end up as a minority and lose their influence unless they seek closer co-operation with their partners. Within the Union of 25 member states, an 'offensive Franco-German harmony' requires a counterbalance by way of the deliberate integration of other partners. Otherwise, Paris and Berlin may harm European community achievements (such as in the debate on the SGP), or even their own legitimacy as the driving force of European integration. Thirdly, as it will be difficult to reach compromises by proxy in the future due to the diversity of national interests in a Union of 25 and more, and considering that it will become impossib

Abstract
This is the National Report on German Law regarding property relations in social unions, like marriage, other legally acknowledged unions, and de-facto unions. It covers heterosexual and same-sex unions. Although the special focus of the report is on international relations (international jurisdiction and recognition of foreign acts; private international law), the substantive law of matrimonial property and property relations in similar unions will be discussed, too, in order to give a better understanding of the rules and problems of German law in the international context. This will also facilitate the comparison between different national laws in Europe, and allow the identification of common problems as well as national peculiarities. It will be shown that the changes that were caused by the rise of the principle of equality between husband and wife are nearly completed now, while new problems are caused by the rise and legal acceptance or even regulation of non-marital unions. The legal developments in other countries will be taken into account insofar as they may affect the operation of German private international law. The Foundation project 'Attractive workplace for all: A contribution to the Lisbon Strategy at company level' aims at identifying pioneer company practices, policies and agreements and showing how the Lisbon strategy is being implemented on the ground at company level. Examples of innovative company practice were gathered from several Member States. In this report, case examples for Germany are organised under the following six thematic headings: fostering employability; increasing labour market participation of underemployed groups; integration into the labour market of people at risk of exclusion; make work pay, make work attractive; towards a balanced flexibility; and business creation and entrepreneurship. Abstract
The Directives aim to provide legal tools protecting individuals against discrimination in the public and in the private sphere. The values the Directives aim to protect are therefore part of the core of the German legal system. The regime of legal regulations envisaged by the Directives have, in addition, already partly been a reality of Germany's legal system as regards discrimination based on sex (which is not covered by this report) and disability. These regulations and their interpretation by federal courts include the definition of discrimination,the shift of the burden of proof, legal standing and a regime of sanctions. The final implementation of the Directives through the AGG and accompanying legislation is therefore not a radical new start for German law but the further development of relevant parts of the existing law. Title: Best practice in governance of agencies : A comparative study in view of identifying best practice for governing
agencies carrying out activities on behalf of the European Union
Abstract
The comparative study comprises "public organisations outside core government" in seven EU Member States (Germany, Hungary, Italy, the Netherlands, Poland, Sweden, and the United Kingdom) and the EU agencies. Federal agencies in the USA are considered briefly. The report deals with agency governance at the three levels of (1) institutional design and the set up of agencies, (2) the (day-to-day) management and steering of agencies, and (3) agency accountability towards other actors (including audit) and transparency. The proposed recommendations for EU agencies include the following ones: - limitation of number of agency types, - stakeholders to be represented in management boards, - agency staff to be recruited by open competition procedure, - creation of an agency only after passing the recommended checklist, - EU agencies to have managerial autonomy regarding finances and personnel, - legal oversight by only one principal, - governance by yearly performance agreement with limited number of objectives, - regular scrutiny by EP committees and by the general public, - regular and ad-hoc audit by the European Court of Auditors, - clearly defined appeals process for each EU agency.
