Title: Minority Rights in the Western Balkans
Abstract
Executive summary Minority rights have received increasing attention in recent decades, and are the subject of various international treaties and frameworks. Given the demographic complexity of the region and its recent turbulent history of ethnic relations, minority protection is of particular importance in the Western Balkans, a region which comprises Albania, Bosnia and Herzegovina, Croatia, Kosovo, FYRoMacedonia, Montenegro and Serbia. There is no consensus on the definition and characteristics of a minority, and this issue is often politically contested. Most commonly, a minority is considered a non-dominant group with an identity distinct from that of the majority population in a country. Minority rights refer to group-specific rights, in addition to general human rights and civil and political liberties, that any individual member of the minority can choose to enjoy. Minority protection refers to the overall institutional and policy framework in which these minority rights are embedded. Importantly, minority protection will only be effective when both majority and minority groups have incentives to adhere to the established institutions and rights. The extent and nature of legal frameworks for minority rightsconstitutional and other legal instruments, international commitments, and bilateral treaties and agreementsvary considerably across the Western Balkans region. On the whole, however, the legal provisions for minorities are extensive in all countries, and they have all signed up to most relevant international treaties and frameworks. Abstract
Some transformations occurred in the area of private property ownership following the change of political regime in former socialist or communist countries. The six analysed countries (Albania, Bosnia and Herzegovina, Bulgaria, Croatia, Romania and Serbia) illustrate well the whole range of contentious problems in a region where the Communist regimes have varied tremendously in their approach to private property, intensity of social control, repression and overall legitimacy. This diversity of situations poses today different types of dilemmas for the property restitution process and these six countries responded in different manners to these general challenges, in the context of their own peculiar social and economic history. Abstract
The Mapping of sector strategies in Western Balkan countries (the former Yugoslav Republic of Macedonia, Montenegro, Bosnia and Herzegovina, Kosovo2, Serbia, Albania) and Turkey is a study and an evaluation on the sectors’ readiness (maturity) for a Sector Approach. Based on qualitative and quantitative data, sectors that are considered priority or might become priority for the EU support in the programming period 2014-2020 have been analysed. This report provides findings and recommendations on the national sector strategies, the existing institutional structures and the mechanisms for strategic planning in priority sectors in the beneficiary countries in the application of a sector approach and recommendations to assist the DG Enlargement of the European Commission in improving programming and performance of IPA II financial assistance.
