Title: Minority Rights in the Western Balkans
Abstract
Executive summary Minority rights have received increasing attention in recent decades, and are the subject of various international treaties and frameworks. Given the demographic complexity of the region and its recent turbulent history of ethnic relations, minority protection is of particular importance in the Western Balkans, a region which comprises Albania, Bosnia and Herzegovina, Croatia, Kosovo, FYRoMacedonia, Montenegro and Serbia. There is no consensus on the definition and characteristics of a minority, and this issue is often politically contested. Most commonly, a minority is considered a non-dominant group with an identity distinct from that of the majority population in a country. Minority rights refer to group-specific rights, in addition to general human rights and civil and political liberties, that any individual member of the minority can choose to enjoy. Minority protection refers to the overall institutional and policy framework in which these minority rights are embedded. Importantly, minority protection will only be effective when both majority and minority groups have incentives to adhere to the established institutions and rights. The extent and nature of legal frameworks for minority rightsconstitutional and other legal instruments, international commitments, and bilateral treaties and agreementsvary considerably across the Western Balkans region. On the whole, however, the legal provisions for minorities are extensive in all countries, and they have all signed up to most relevant international treaties and frameworks. Abstract
This report presents comprehensive analysis and policy-relevant findings on the quality of life in three EU candidate countries: Croatia, the former Yugoslav Republic of Macedonia and Turkey (the CC3). Findings are based on Eurofound’s second European Quality of Life Survey (EQLS 2007). Quality of life is analysed in different social domains, based on objective as well as subjective indicators. The report addresses the perceived economic situation of households, family life, housing and local environment, health and access to health services, perceived quality of society, and subjective well-being, as well as interrelations between these factors. In investigating these domains in greater detail and comparing social groups within and between the countries, the report provides essential information both for understanding country backgrounds and for future policy planning. Title: Former Yugoslav Republic of Macedonia (FYROM) : Industrial relations profile
Abstract
From the beginning of the political and economic transition, the legal context has been rather favourable to industrial relations. In the constitution of 1991, the former Yugoslav Republic of Macedonia was proclaimed as a social state with high level of provision of social and economic rights, including the right of labour to be organised for the promotion of its interests. Strikes and collective bargaining became constitutional categories and the constitution created very flexible provision for the participation of the labour in management of firms. The constitution states that ‘ownership and labour form the basis for management and sharing in decision-making’. These basic values promoted in the constitution were operationalised in many laws, the pillar of which is the Labour Code. In the process of harmonisation of this regulation with EU standards many laws were revisited, and many new ones created. Some analysts highlight two tendencies in this process of revision. One of these tendencies is the significant enlargement of the Labour Code with many new provisions concerning discrimination, collective bargaining, trade unions and strikes.
