Title: Iran and the Nuclear non-proliferation Treaty
Abstract
This Briefing Paper examines the legal basis of EU policy towards Iran in the context of the Nuclear Non-Proliferation Treaty (NPT) and of the International Atomic Energy Agency (IAEA) legal framework. Its major emphasis is on the compatibility of the Paris Agreement concluded between the EU and Iran on 15 November 2004 with the stipulations of the NPT. In addition, the Briefing Paper addresses also the issue of Tehrans reduced cooperation with the IAEA and its repeated threats to withdraw from the NPT. The analysis of this Briefing Paper predates the June 2006 incentive package agreed upon by the P-5 plus Germany. But, guided by the Diplomacy First! principle, it makes some recommendations for the EU role in the context of the efforts of direct diplomacy efforts between Washington and Tehran in a multilateral setting.[European Parliament]

Title: The United Nations Convention on the Law of the Sea: Developments, Challenges and Perspectives
Abstract
This study seeks to provide an analysis of the 1982 United Nations Convention on the Law of the Sea, with particular reference to fisheries management and to the European Community (EC). The report provides a brief synopsis of the Convention, including the mechanisms for review and amendment of the Convention and for EC participation in the Convention, together with a more detailed analysis of its provisions on fisheries.The relationship between the Convention and issues of recent concern in international fisheries management is considered. These issues include the regulation of straddling and highly migratory fish stocks, the role of regional fisheries management organisations (RFMOs), driftnet fishing, fisheries bycatch and discards, the promotion of sustainable fisheries and illegal, unreported and unregulated (IUU) fishing.[European Parliament]

Abstract
There is no universally agreed definition of torture. The most widely quoted definition is from the UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment ("Convention against Torture"). Article 1 of that Convention defines torture as "any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed or is suspected of having committed, or intimidating or coercing him or a third person, or for any reason based on discrimination of any kind, when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity".[European Parliament]

Despite the large role that the European Union (EU) and its member states play in the disbursement of official development assistance globally, coordination among European member states in the organisation of their bilateral aid programmes is relatively limited. This complicates the ability of the members to act in a cohesive, coordinated manner in international financial institutions that play a development role, in particular, the International Monetary Fund (IMF) and the World Bank. Title: The Role of Small and Medium Enterprises in Developing Countries
Abstract
Development thinking towards small and medium-sized enterprises (SMEs) has shifted in its emphasis over the years. In the 1980s, led by the World Banks Get your prices right approach, small firm policy was focused on economic development through business development and access to capital. During this time SMEs were hailed, as had trade been before them (Lewis, 1954), as the new engine of growth for developing countries (DCs). By the 1990s the emphasis had shifted towards social development and therefore less interest was paid to fostering SMEs (CFED, 2004). In the last few years, however, a more holistic approach to dealing with inequities in the global economy has emerged, and SMEs are now viewed as a means of achieving both economic and social development through poverty reduction (CFED, 2004). During the first five years of this decade the World Bank has approved over $10 billion to support the growth of small firms, and indications from the Bank are that this support will continue (World Bank, 2002 and 2004).[European Parliament]

Title: Visibility and impact of EU Activity in the UN and its Various Programmes, Funds and Agencies
Abstract
This study analyses the visibility and impact of the European Community in the UN system in the light of its financial contributions. While the Community functions as a donor in its own right, it is not a member of the United Nations to which only sovereign states can adhere. Therefore, formal representation of the Community in the UN system remains weak. Whether this constitutes an impediment to the ECs impact on UN policies is discussed with the help of a detailed empirical analysis of EC financial contributions to 23 selected UN bodies, and, on the theoretical level, with the help of two different models - the Full Membership Approach and the "No Flagwaving" Approach. The study reaches three main conclusions. First, return on EC investment - in terms of visibility and impact - can be regarded as satisfactory. Second, the EC should not aim at becoming "just another donor" in addition to its Member States. Third, the Community may embrace a potentially strong role under the condition that it defines its approach to EU-UN relations and Development Policy on the basis of its specific nature.[European Parliament]

Title: The potential role for collective preferences in determining the rules of the international trading system
Abstract
The study examines the concept of collective preferences and their potential role in defining international trade rules. Based on the initiative of Pascal Lamy in 2004, the paper explores the extent to which current trade rules already reflect collective preferences and discusses the inclusion of the concept into international trade rules, including a temporary safeguard clause accompanied by a compensation mechanism. The main focus is on whether the concept of collective preferences can provide the multilateral system with better responses to societies expectations and fears concerning globalisation. Title: Assessment of the proposed Reform of the Generalised System of Preferences
Abstract
This policy paper reviews the draft Regulation for a new Generalised System of Preferences (GSP) in the light of the reform strategy prepared by the European Commission in July 2004. The reform of the GSP is of great potential significance both for the EUs overall trade policy and for its development policy. This policy paper identifies the key changes foreseen in the draft Regulation and assesses their potential impact, with a particular focus on graduation, the GSP+ scheme and the links with the Cotonou agreement. The paper looks at product coverage, WTO compatibility and identifies potential winners and losers of the new GSP system. The authors even address the difficulties encountered by policy-makers with regard to rules of origin, closely linked to the GSP scheme.[European Parliament]

Abstract
With the end of the Agreement on Textiles and Clothing and the removal of all textiles and clothing quotas on 1 January 2005, the characteristics of global textile production patterns and trade flows will be substantially redesigned. This paper aims at evaluating the qualitative and quantitative impact of the removal of quotas by assessing the prospects for textile- and clothing-producing countries, as well as producers and consumers in the EU. Title: Respecting Human Rights and Fundamental Freedoms and EU/UN Sanctions : State of Play
Abstract
Executive summary The present study examines a number of issues concerning the EUs own (autonomous) sanctions (also called restrictive measures) and EU sanctions implementing UN Security Council sanctions. The interplay between the international, EU and national constitutional legal systems causes problems and creates complexity in this field but the scope for simplifying this is limited. UN and EU sanctions have very different legal bases at international law. Under EC Law, the legal basis and procedures to be followed for introducing trade/aid suspension measures is quite different from the legal basis and procedure to be followed for introducing CFSP sanctions. This distinction between the two legal bases is retained in the Lisbon treaty, although there is some increased scope for integrating these two bases. UN and EU targeted sanctions work by means of blacklisting. The procedures for blacklisting are different depending on whether the targets are governments or terrorist organisations. Identification of terrorist suspects as compared to governmental members is a much more uncertain process. [...] [Prof. Iain Cameron]
