Title: Périodes transitoires négociées par les adhérents
Abstract
The paper lists all the transition periods negotiated by the 10 acceding countries in the final stage of accession negotiations with the European Union at the end of 2002. These transition periods are derogations to EU law and are limited in duration. They have been accorded to the future Member States so that they can gain a competitive advantage from temporary non-application of EU law. In certain areas, transition periods were negotiated collectively, for example in the area of free movement of people. In other areas, they were negotiated individually, for example for competition. In all instances, these derogations are strictly limited in duration and cannot be prolonged, except through negotiations. The Commission is responsible for the monitoring of their application. Abstract
Mit der Annahme der Verordnung (EG) Nr. 1172/98 des Rates im Mai 1998 wurde ein wichtiger Schritt auf dem Weg zur gemeinschaftlichen Verkehrsstatistik in der Europäischen Union gemacht. Diese Verordnung liefert die Rechtsgrundlage für die Erfassung einer großen Bandbreite von Daten über den Güterkraftverkehr. Mit dem vorliegenden Referenzhandbuch soll den Mitgliedstaaten und den beitrittswilligen Ländern eine ausführliche Anleitung für die Durchführung dieser Verordnung an die Hand gegeben werden. Das Handbuch ist in die folgenden drei Teile gegliedert: Teil A : Empfehlungen für Stichprobenerhebungen des Güterkraftverkehrs, Teil B : Empfehlungen für die Variablen, Definitionen und Erläuterungen, Teil C: Regeln für die Datenübermittlung an Eurostat, Datenvalidierung durch Eurostat und Regeln für die Verbreitung von Daten durch Eurostat. Abstract
The Proposal for a Regulation on maintenance obligations (PRMO) and the Preliminary Draft Hague Convention and Protocol on family maintenance (PDC and PDP) have a different scope, both substantive and personal. Limited interference between the PRMO and the PDC may occur in respect of jurisdiction rules since the latter does not provide rules of direct jurisdiction. The indirect rules of jurisdiction of the PDC will have an impact at the phase of recognition and enforcement of a decision given in a Member State. As concerns the designation of the applicable law, both instruments allow a limited party autonomy and aim at the protection of the maintenance creditor, that usually is the weaker party. Nevertheless, due account is taken of the interest of the debtor. Should the Community and its Member States decide to become parties to the PDP, difficulties may arise in this field in case of inconsistencies between the two sets of rules since both will apply erga omnes. In respect to recognition and the enforcement of judgments some interference between the two systems is possible in particular cases notwithstanding Article 49. It appears that the EC and the Member States will share the external competence to enter into the Hague instruments. [European Parliament]

Abstract
This note takes into consideration the evolution of the legal basis of the private international law rules common to the Member States and sets out to distinguish the following stages and categories of private international law legislation within the context of Europe: - private international law conventions concluded between Member States, but which have no legal basis in the Treaties; - agreements concluded between Member States under the third pillar following the adoption of the Maastricht Treaty; - acts of secondary legislation under Title IV of the EC Treaty, as introduced by the Amsterdam Treaty, which "communitise" earlier agreements; - new private international law rules contained in acts of secondary legislation amending private international law rules between the Member States and between those States and third countries which are directly adopted on the basis of the Title IV of the EC Treaty in the absence of an existing convention; - new Community rules adopted on the basis of Title IV in a field already partially governed by agreements concluded within a non-Community framework such as the Hague Conference on Private International Law, to which all the Member States are parties. Darüber hinaus wird die Effektivität von Mindestanlandegrößen und Sperrgebieten als Erhaltungsinstrumente beleuchtet, und es werden die jeweiligen Vorzüge des Top-down- und des Bottom-up-Ansatzes für die Festlegung von technischen Maßnahmen erörtert. Title: The benefits of strict cut-off criteria on human health in relation to the proposal for a Regulation concerning plant
protection products
Abstract
This study assesses the health benefits of strict "cut-off criteria" on human health in relation to the proposal for a Regulation concerning the placing of plant protection products on the market (COM(2006) 388). The Common Position text provides that active substances classified as carcinogen, mutagen or toxic for reproduction category 1 or 2 (CMR 1 & 2), or substances considered to have endocrine disrupting properties (ED) on the basis of internationally agreed test guidelines, shall not be approved unless exposure to humans under realistic proposed conditions of use would be negligible. The European Parliament in its first reading amendments proposed the additional criteria that substances "considered to cause a risk of developmental neurotoxic or immunotoxic properties in humans, taking into account exposure during embryonic/foetal life and/or during childhood as well as likely combination effects" should only be approved if human exposure would be negligible. In view of the continuing debate about the criteria for approval of active substances, this study provides a scientific review of evidence concerning human health effects of plant protection products, including health benefits that could accrue from the stricter cut-off criteria. The study supports the proposal of the European Parliament that in order to ensure added protection of human health, substances considered to cause a risk of developmental neurotoxic or immunotoxic effects in humans should be added to the list of classifications that would result in non-approval of active substances, unless negligible exposure can be demonstrated. Title: Study on third-party testing of toys ; IP/A/ALL /FWC/2006 -105/LOT 3/C1/SC 4
Abstract
The European Toy Safety Directive 88/378/EEC (TSD) regulates the EU toy sector through safety criteria and essential requirements which toys must meet before being placed on the EU market. The European Commission has now put forward a proposal for a new TSD. One of the key questions during drafting of the proposal for a new Directive was whether to make it mandatory for all toys to be tested by an independent third-party tester, which is not the case today. However, based on an Impact Assessment carried out in 2004, the Commission decided not to include mandatory third-party testing of toys in the proposal for a new TSD. The objective of this study is to outline the merits and drawbacks of mandatory third-party testing of toys, by providing facts on the current situation and different stakeholders opinions on mandatory third-party testing of toys. Abstract
This briefing paper provides a preliminary analysis of the transposition, implementation and enforcement of the Directive on unfair commercial practices (2005/29/EC) and the Directive concerning misleading and comparative advertising (2006/114/EC). The paper responds to a request by the Committee on the Internal Market and Consumer Protection of the European Parliament. The analysis is focused on the transposition process in Austria, France, Germany and the United Kingdom, but also provides examples from other Member States, in particular Belgium, Denmark, Czech Republic, Ireland, Italy, Malta, Portugal, Romania, Slovenia and Sweden.
