Part One of the study is a history of the Euratom Treaty, which covers the period from the early 1950s to the late 1960s. Part Two of the study considers and analyses the most important provisions of the Euratom Treaty, chapter by chapter, and then Part Three offers some thoughts on possible strategies which the Parliament might use so as to reduce the ?democratic deficit? which is generally thought to characterise the Euratom Treaty. Title: Périodes transitoires négociées par les adhérents
Abstract
The paper lists all the transition periods negotiated by the 10 acceding countries in the final stage of accession negotiations with the European Union at the end of 2002. These transition periods are derogations to EU law and are limited in duration. They have been accorded to the future Member States so that they can gain a competitive advantage from temporary non-application of EU law. In certain areas, transition periods were negotiated collectively, for example in the area of free movement of people. In other areas, they were negotiated individually, for example for competition. In all instances, these derogations are strictly limited in duration and cannot be prolonged, except through negotiations. The Commission is responsible for the monitoring of their application. Title: Summit collapse: ongoing crisis for the enlarged EU
Abstract
The paper argues that the collapse of the European Council Summit in Brussels on 13 December 2003 and the failure to agree the new constitutional treaty throws the Union into a major and unprecedented crisis. Attempts by many EU politicians to talk the severity of the crisis down will not help in building a rapid and effective response to it. The Laeken ambitions of a new treaty to ensure a more democratic EU closer to the people, an efficient enlarged EU and a Union with a real voice in global affairs, lie in ruins for now. And this is indeed a crisis about enlargement, since it was the new EU of 25 that, in an unprecedented manner, failed to find a compromise to finalise the two years of work spent drawing up the constitutional treaty draft. Time will tell if the current crisis is a real turning point in the Union's development or if, in the end, it will be seen as a damaging, messy but ultimately surmounted crisis. The real losers for now are political relations in the new EU; public opinion; EU debate; democracy; and the EU's role in the world. Losses will be greater still if the new treaty is never agreed. Title: The Czech reaction to the IGC failure - disillusion or indifference?
Abstract
The paper examines the position of the Czech Government at the final session of the Intergovernmental Conference (ICG) on 12 December 2003 in Brussels. The Czech Government was keen to show that the Czechs did not have any "red lines" in the negotiations. The issue of full representation in the Commission which earlier had seemed to be the priority on the Czech agenda was suddenly off the table, and Czech Prime Minister, Vladimir Spidla, announced that it was a priority to get a deal on voting. The Czech delegation tabled its own proposal, suggesting that there should be a parity between the Member States and their populations in the Council (either 50%-50%, 55%-55%, 60%-60%). But the Italian Presidency did not take up this proposal despite the fact that it enjoyed some support of other Member States. Title: Progress and Obstacles in the Area of Justice and Home Affairs in an Enlarging Europe
Abstract
This paper assesses the legislative achievements made so far in the objectives set by the Amsterdam Treaty and the Tampere European Council. It explores why a number of Justice and Home Affairs (JHA) policy areas have experienced a greater degree of development or convergence than others. The road to establish a genuine area of freedom, security and justice (AFSJ) is still a long one. The widely held view of these issues as matters of national sovereignty continues to create obstacles to progress in this area. The legislative progress attained so far shows the difficulties of arriving at European policies on, immigration and asylum, as well as the rights of third-country nationals. A low level of convergence and progress towards issues related to freedom in these three areas can be appreciated by looking at the progress of the Tampere scoreboard. Higher levels of trust, flexibility, co-ordination and efficiency, in terms of cost and rapidity of response, are required to overcome these tensions. The right balance between freedom, security and justice needs to be ensured. Security and law enforcement policies need to be developed with freedom as the point of departure. A danger of the aftermath of the 11 September 2001 terrorist attacks and the current preoccupation with undocumented / illegal immigration is that a pattern may be established that leads to overly zealous security policies for European society, with adverse effects on the internal cohesion of Europe. In particular, certain minority groups may feel that they are subject to excessive attention by security forces. In addition, it is also perceived that the terrorist attacks in the USA have radically changed perceptions of security in the EU. Undoubtedly, these attacks have provided a new impetus for the development of the AFSJ. Title: Die Beitrittsverträge der EU - eine Bilanzierung
Abstract
This paper analyses the duties and rights that the Treaty of Accession allocates to the 10 new member states of the European Union on the basis of the common European law. Since the EU of the current 15 member states did not sufficiently adjust the European institutions, the structure of competencies and the common policies to the requirements of an enlarged Union, the enlargement will not be an economic success, it considers. The reform of the Common Agricultural Policy (CAP) and the structural policies will become even more difficult within the enlarged EU of 25 or more member states; the new member states will be net beneficiaries of the CAP and the structural funds, and as such will not favour reform. The paper considers that consumers will probably not win and that taxpayers in old member states will lose. The reserves for the payment liabilities that arise from the Treaty of Accession will amount to a total of up to u0080 543 billion for the EU of the current 15 member states, of which u0080 132 billion for Germany alone over the 30 years after enlargement (assuming an annual interest rate of 5%). The expenses of the enlarged Union will rise progressively over the next 25 years until EU subsidies per inhabitant in the new member states are as high as in the current member states. [Urheber s. Abstract
This report presents the results of seven hearings on enhanced cooperation between European Union member states in the light of the changes made by the Treaty of Amsterdam. In this Treaty, the member states added a number of important new clauses on enhanced cooperation. The most momentous innovation brought by these clauses was that enhanced cooperation between member states, which had been practised in a freely agreed manner outside the Treaty system proper since the early days of European Integration in the 1950s can now be implemented within the institutional framework of the EU, and utilise its institutions and procedures. The organisation of the hearings and the types of questions asked derived from the organisation of these new clauses on enhanced cooperation in the Treaty of Amsterdam. [author's abstract]

Title: Flash Report 2nd Interinstitutional Conference on Drugs Policy in Europe

Abstract
Overall, the Conference was very satisfactory, as it allowed the representatives of national authorities and of civil society to discuss the main issues on drugs in a wide ranging and open debate, and to reach a general consensus on most points. There were repeated calls for a radical rethink of drug policy, including legalisation, from a number of NGOs, but this did not receive much support. A recurrent theme was the need for a comprehensive cost / benefit analysis and evaluation of all actions taken in drugs policy. It was suggested that co-operation and co-ordination of the drugs policies of the Commission and the Member States should be enhanced and an EU mechanism to fulfil this task, such as regular meetings of national drug co-ordinators, should be set-up. The Conference, whose moderator was Professor Lafargue, was opened by Mr Vitorino, European Commissioner responsible for drugs co-ordination, Mr Canas, Portuguese Secretary of State to the Presidency of the Council of Ministers and Ms Giannakou-Koutsikou, member of the European Parliament. There were then statements by the ex-Presidency of Finland on the EU Drugs Strategy 2000-2004 endorsed at the Helsinki European Council, the EMCDDA and Europol. The remainder of the meeting was divided into five sessions of at least two hours. Each session began with a presentation by an acknowledged expert in the field (eg EMCDDA, Europol or UNCDP) and was followed by discussions between all interested participants.
