Abstract
The study is a resource text for Members of the EP Delegation to the European Convention and other participants and observers of the Convention and its Working Groups. It provides a succinct comparative description and evaluation of the attribution of powers and the resolution of disputes in four selected federal systems (USA, Germany, Switzerland and Belgium), with some short comments on the European Union's own system of multi-level governance.[European Parliament]

This report addresses the use of benchmarking as a management tool in the context of local authority actions towards sustainability management. The growing interest at the European policy-making level in stimulating the use of sustainability management tools and exchange of best practices among local authorities has motivated its publication. Title: Périodes transitoires négociées par les adhérents
Abstract
The paper lists all the transition periods negotiated by the 10 acceding countries in the final stage of accession negotiations with the European Union at the end of 2002. These transition periods are derogations to EU law and are limited in duration. They have been accorded to the future Member States so that they can gain a competitive advantage from temporary non-application of EU law. In certain areas, transition periods were negotiated collectively, for example in the area of free movement of people. In other areas, they were negotiated individually, for example for competition. In all instances, these derogations are strictly limited in duration and cannot be prolonged, except through negotiations. The Commission is responsible for the monitoring of their application. Abstract
This background note analyses the institutional and legal implications of the use of soft law instruments on the EU level. It begins with introducing the concept of soft law in EU law. The discussion then follows with defining various categories of Community soft law that have been developed by Community institutions. Further, it elaborates on the competence of Community institutions to adopt soft law acts. After examining the nature and the role of Community soft law, the discussion turns to the issue of simplification and improvement of EU regulation. The background note ends with summoning the role and relevance of soft law with regard to achieving better regulation and good governance in the EU. It also concludes on the urgent necessity to increase the implication of the Parliament in the elaboration process of soft law.[European Parliament]

Abstract
The Directives aim to provide legal tools protecting individuals against discrimination in the public and in the private sphere. The values the Directives aim to protect are therefore part of the core of the German legal system. The regime of legal regulations envisaged by the Directives have, in addition, already partly been a reality of Germany's legal system as regards discrimination based on sex (which is not covered by this report) and disability. These regulations and their interpretation by federal courts include the definition of discrimination,the shift of the burden of proof, legal standing and a regime of sanctions. The final implementation of the Directives through the AGG and accompanying legislation is therefore not a radical new start for German law but the further development of relevant parts of the existing law. Title: The Constitutional Reform Process in Bosnia and Herzegovina
Abstract
The paper examines the structural weaknesses of Bosnia and Herzegovina's "consociational" political system, resulting from the 1995 Dayton Agreement. It highlights a high degree of institutional fragmentation, leading to disproportionate costs for bureaucracy, and far-reaching veto modalities which reinforce ethnical divides, rather than providing incentives to work together. Reviewing the various failed attempts to amend the constitution over recent years, the authors also note that the authority and legitimacy of the international community's High Representative/EUSR are fading, and that the EU's traditional approach via the accession incentive will not work here. In conclusion, they argue for a fresh approach to state reform, supported by increased EU commitment to reconciliation and state-rebuilding efforts. [Tomislav Marši?, Josef Mark]

Abstract
This report was financed by and prepared for the use of the European Commission, Directorate-General for Employment, Social Affairs and Equal Opportunities. The MEDIS project was coordinated by Patrick Simon from the Institut National d'Etudes Démographiques and Martin Clément from Economie et Humanisme (France). As part of its initiatives, the programme specifies that it will support 'the development and dissemination of comparable statistical series data on the scale of discrimination", and "the development and dissemination of methodologies and indicators to assess the effectiveness of anti-discrimination policy and practice'.
