Title: Progress and Obstacles in the Area of Justice and Home Affairs in an Enlarging Europe
Abstract
This paper assesses the legislative achievements made so far in the objectives set by the Amsterdam Treaty and the Tampere European Council. It explores why a number of Justice and Home Affairs (JHA) policy areas have experienced a greater degree of development or convergence than others. The road to establish a genuine area of freedom, security and justice (AFSJ) is still a long one. The widely held view of these issues as matters of national sovereignty continues to create obstacles to progress in this area. The legislative progress attained so far shows the difficulties of arriving at European policies on, immigration and asylum, as well as the rights of third-country nationals. A low level of convergence and progress towards issues related to freedom in these three areas can be appreciated by looking at the progress of the Tampere scoreboard. Higher levels of trust, flexibility, co-ordination and efficiency, in terms of cost and rapidity of response, are required to overcome these tensions. The right balance between freedom, security and justice needs to be ensured. Security and law enforcement policies need to be developed with freedom as the point of departure. A danger of the aftermath of the 11 September 2001 terrorist attacks and the current preoccupation with undocumented / illegal immigration is that a pattern may be established that leads to overly zealous security policies for European society, with adverse effects on the internal cohesion of Europe. In particular, certain minority groups may feel that they are subject to excessive attention by security forces. In addition, it is also perceived that the terrorist attacks in the USA have radically changed perceptions of security in the EU. Undoubtedly, these attacks have provided a new impetus for the development of the AFSJ. Title: A comparison of the now agreed VIS package and the US-VISIT system
Abstract
In recent years, U.S. and EU have both set up border-related database systems with striking similarities as regards names and major development phases occurring in the historical context of post-9/11. Nevertheless doubts are appropriate as to how far the parallels go between the European VIS finally adopted as an instrument of the common visa policy and US-VISIT known for its dedicated role in the war against terrorism. On the basis of a detailed examination of systems and contextual features, the present briefing undertakes to illustrate major divergences in terms of underlying purposes and means employed which once again confirm well-known transatlantic divides as to the significance of data protection, availability of data to a wide range of security authorities, perfectionist use of biometric control processes etc. The transatlantic comparison also takes note of rather disillusioning experiences made by US-VISIT: despite deployment of enormous financial resources, newest technology and the envisaged use of accompanying measures such as ETA, the modernisation of the Visa Waiver Program (VWP), the seamless protection of US borders appears still not in sight. This paper provides background information for the Conference of the Parties to the UNFCCC (COP) and the Conference of the Parties serving as the Meeting of the Parties to the Kyoto Protocol (COP/MOP) in December 2007 in Bali, Indonesia. Significant action is required at the highest urgency to ensure that global greenhouse gas emissions peak until 2015 and decline to at least half of current levels to prevent dangerous interference with the climate system (chapter 2). Title: Progress Made and Existing Gaps in the Field of Judicial co-operation in criminal matters
Abstract
The briefing note provides an overview of the progress made and existing gaps in the field of judicial co-operation in criminal matters. It first reviews perceived difficulties with the pillar structure and examines the amendments that the Reform Treaty - due to be formally adopted at the European Council in December 2007 - would introduce. The different approaches to co-operation at a European level, i.e. mutual legal assistance, mutual recognition and approximation are also analysed. A particular emphasis is placed on current legislative proposals and other developments, such as the current state of play of the European Arrest Warrant, Eurojust and the European Judicial Network in criminal matters. Title: Biofuels sustainability criteria. Relevant issues to the proposed directive on the promotion of the use of energy from
renewable sources {COM(2008) 30 final}
Abstract
The role envisioned for liquid biofuels for transport has come under increased scrutiny in the past year or two, due to the potential social and environmental impacts associated with scaling up biofuels production and use from its low level?currently representing about 1% of transport fuels globally. The proposed EU Directive setting a target of 10% biofuels in transport sector by 2020 has therefore raised a number of concerns. The concerns about sustainability are addressed within the proposed Directive through criteria related mainly to GHG emissions, but also to biodiversity and other environmental impacts. The use of first generation biofuels in temperate climates is land-intensive and inefficient in technical terms, whereas first generation biofuels in tropical climates and second generation biofuels in general?offer a much more effective use of land resources. The use of GHG reduction criteria can provide incentives for producers to rely on the most productive feedstocks when sourcing biofuels for the EU market, which will often mean import of biofuels. A threshold of 50% or more would tend to eliminate many of the first generation biofuels produced in temperate climates. Member States should be encouraged to link financial incentives to the GHG reduction capabilities. Moreover, such incentives could be better linked to development cooperation in the case of imports, so as to insure that Least Developed Countries (i.e. in Africa) can gain access to larger markets rather than only the major producers such as Brazil. The calculation of GHG emissions associated with biofuels is complicated by the addition of factors associated with land use change, since the GHG impacts of land use change are beset by uncertainty both in physical terms as well as in the attribution of particular changes to production of particular biofuels. Title: Misleading practices of ?directory companies? in the context of current and future internal market legislation aimed at
the protection of consumers and SMEs
Abstract
Executive summary This study by Civic Consulting provides an overview of the extent of the problem of directory companies reported to apply misleading practices. It describes judicial and nonjudicial measures taken by affected enterprises and discusses initiatives by Member States aimed at tackling these practices. The study further presents an overview of the current EU legal framework and its national implementation. Finally, the study presents overall conclusions with a discussion of options for EU-level action. The analysis of this study has been based on several resources. Stakeholders and competent authorities have been involved throughout the process of the data analysis by means of interviews and surveys. Several case studies were carried out for the report to document court cases and actions taken against directory companies reported to apply misleading practices. A detailed legal analysis for three Member States was carried out (for Austria, the Netherlands and Spain). The country reports examine the transposition of the Directive concerning Misleading and Comparative Advertising and the Unfair Commercial Practices Directive into national legislation, and possible resulting loopholes, as well as jurisprudence and other measures taken by the respective Member States. Title: Data protection from a transatlantic perspective : the EU and US move towards an international data protection agreement

Abstract
Recent years have been marked by a growing demand of personal data for public security purposes. Access and protection of those data are climbing the transatlantic political agenda. They have raised tensions and fostered forms of cooperation. The possible conclusion of an international binding agreement on a common transatlantic framework on data protection would be a further and crucial step ahead. The scope of this study is to pave the way for launching a parliamentary debate on those issues. Therefore, it aims at providing a comparative analysis of the EU and US legislation concerning the protection of personal data collected for public security purposes. It also discusses some of the main challenges posed by new technologies as well as analyses the most relevant cases-studies of transatlantic data exchange. Title: Ethnicity and Race-based Profiling in Counter-terrorism, Law Enforcment and Border Control
Abstract
The aim of this study is to synthesize legal arguments and research findings relating to ethno-racial profiling in the field of anti-terrorist policies and legal instruments. The ultimate goal is to formulate guidelines and recommendations for the European legislators. In Part I, the study provides an analysis of the concept and utility of profiling. This includes an assessment of the most important substantive criteria of profiling and the necessary safeguards. Part II focuses on the compatibility of profiling with the most important international, European and national human rights instruments, along with European instruments in the context of the fight against terrorism, police and judicial cooperation and exchange of information and intelligence between Member States, while also taking into account the rights and guarantees provided to individuals in terms of privacy, data protection and nondiscrimination. Part III explores the impact of profiling on minority communities, police-minority relations, and the effectiveness of police and anti-terrorist law enforcement endeavours. Finally, Part IV offers recommendations on possible ways to carry out research on racial profiling and monitoring police activities in order to identify racial profiling practices. Given the demographic complexity of the region and its recent turbulent history of ethnic relations, minority protection is of particular importance in the Western Balkans, a region which comprises Albania, Bosnia and Herzegovina, Croatia, Kosovo, FYRoMacedonia, Montenegro and Serbia. There is no consensus on the definition and characteristics of a minority, and this issue is often politically contested. Most commonly, a minority is considered a non-dominant group with an identity distinct from that of the majority population in a country. Minority rights refer to group-specific rights, in addition to general human rights and civil and political liberties, that any individual member of the minority can choose to enjoy. Minority protection refers to the overall institutional and policy framework in which these minority rights are embedded. Importantly, minority protection will only be effective when both majority and minority groups have incentives to adhere to the established institutions and rights. The extent and nature of legal frameworks for minority rightsconstitutional and other legal instruments, international commitments, and bilateral treaties and agreementsvary considerably across the Western Balkans region. On the whole, however, the legal provisions for minorities are extensive in all countries, and they have all signed up to most relevant international treaties and frameworks.
