The current study reviews and clarifies how the various provisions of the Framework Employment Directive, advance the anti-discrimination idea in the context of employment and disability. Abstract
Sexual orientation as a concept is so far not recognised by Greek Law, which implicitly but systematically recognises, accepts, protects and institutionalises human sexuality that is confined within the limits of the traditional married heterosexual couple. Other forms of sexuality are either: totally ignored, disapproved or tolerated by the law. The absence of any anti-discrimination law (with the exception of gender, race or origin) and the general negative climate have obliged Greek citizens to deny and/or hide their true sexual identity. Abstract
The Human Rights Act 1998 incorporates into the UK law most of the rights in the European Convention on Human Rights and its Protocols , and authorizes UK courts to enforce these ?Convention rights.? None of the existing legislation expressly prohibits sexual orientation discrimintation in employment or occupation. Only the regulations implementing the Framework Directive do so. However, the UK?s implementation of the Framework Directive with regard to sexual orientation to date has been excellent.

Title: Pre-employment inquiries and medical examinations as barriers to the employment of persons with disabilities:
reconciling the principle of equal treatment and health and safety regulations under European Union law
Abstract
This Report presents a legal analysis of the coexistence between regulations seeking to protect health and safety at work and the requirement of non-discrimination in work and employment against persons with disabilities. Its asks whether health and safety regulations may constitute barriers to the employment of persons with disabilities, and, where such barriers exist, which legal responses they call for. It focuses especially on what the right to respect for private life and the rules protecting personal data may contribute to lowering such barriers. Drawing the consequences from the emergence of the principle of equal treatment with regard to persons with disabilities, and from the rise of the civil rights paradigm in disability law generally, it illustrates how the existing regulatory framework may be relied upon in order to effectuate the shift from a « fitness » approach to an «adaptation » approach in the regulation of preemployment inquiries and medical examinations. It insists in particular on the function of the obligation to provide an effective accommodation to persons with disabilities in alleviating the tension between regulations relating to health and safety at work and the prohibition of discrimination. The Foundation commissioned a project into violence and harassment in the workplace in 2002. This report publishes the findings of the project. It identifies the different forms and patterns of violence and harassment in the workplace in the EU and describes the recent upsurge in activity and initiatives with respect to violence and harassment within the legal arena, with new legislation addressing these problems recently enacted or in the pipeline in a number of countries. It also presents evidence of adverse effects on individuals, organisations and society, and assesses the potential financial costs. Finally, it analyses the factors that may contribute to and cause physical and psychological violence, and reviews a variety of good practices with respect to preventing and managing violence and harassment at work. The legal basis of collective bargaining in Austria is laid down by the Labour Constitution Act (ArbVG). According to the ArbVG, collective agreements can be concluded only between collective organisations of employers and employees. The Belgian collective bargaining system is highly institutionalised and coordinated. Over 90% of employees are covered by a collective agreement, placing Belgium among the countries with the highest coverage in Europe. Also, the Belgian trade unions have a relatively high level of membership compared with the European average, with over 50% of employees belonging to a union. Abstract
The right to collective bargaining is set out in the 1972 French Labour Code. In the last decades, collective bargaining has expanded, partly as a result of government initiatives. The importance of sectoral bargaining increased with the adoption of the 1982 Auroux laws, which obliged the bargaining parties already bound by a sectoral agreement to negotiate pay annually and to discuss the sector’s job classification system and its economic development every five years. The Auroux laws also stimulated company-level bargaining by making annual negotiations on pay and working time obligatory in companies with union representation. [Eurofound]

The legal basis of collective bargaining in Germany is laid down by the Collective Agreements Act, 1949. Collective agreements can be concluded between employer associations (or individual employers) and trade unions. In contrast, works councils – statutory employee representation bodies elected at workplace and company level – may only conclude works agreements. Under the Works Constitution Act, these ‘shall not deal with remuneration and other conditions of employment that have been fixed, or are normally fixed, by collective agreement’. [Eurofound]

In Ireland, collective bargaining is organised as a three-tier system, with a dominance of bargaining and complementary bargaining at sectoral and company level. For over two decades collective bargaining, covering the unionised private and public sectors, has been regulated by national tripartite ‘social partnership’ agreements, drawing up guidelines on minimum and maximum wage increases.
