Title: Women and Transport
Abstract
This report sets out the nature of the gender imbalance in the transport sector across the newly enlarged Europe. It highlights the nature of travel differences between men and women as transport users and consumers and the implications this has for the planning, operations and management of the transport system. It sets out the challenges faced by institutions within the transport sector to mainstream gender equality. It also highlights the male-domination of employment within all areas of the transport labour force and the few examples of good practice that are trying to overcome women's under-representation in this industry. The report sets out the criteria for a European transport system with gender equality at its core and a series of concrete actions appropriate to start on that journey.[European Parliament]

Abstract
Die Studie „Frauen in ‘einfachen’ Tätigkeiten”, die im Auftrag des Europäischen Parlaments (Directorate-General Internal Policies of the Union – Directorate C – Citizens’ rights and Constitutional Affairs) erstellt wurde, verfolgt im Wesentlichen drei Zielsetzungen: • eine Beschreibung und eine erste quantitative Bestimmung einfacher bzw. gering qualifizierter Arbeit aus der Gender-Perspektive; • die Identifikation von Beispielen guter Praxis in den unterschiedlichen nationalen Kontexten und verschiedenen Branchen, die zu einer positiven Wahrnehmung und höheren sozialen wie ökonomischen Wertschätzung gering qualifizierter Arbeit beigetragen haben; • die Ableitung von Schlussfolgerungen und Empfehlungen zur Verbesserung der gesellschaftlichen Wahrnehmung und des Status von gering qualifizierter Arbeit und gering qualifizierten Beschäftigten. Die Studie bezieht sich auf drei Länder: die Tschechische Republik (CZ), Deutschland (DE) and das Großbritannien (UK). Die Länderauswahl ist begrenzt, repräsentiert aber gleichwohl eine breite Vielfalt unterschiedlicher institutioneller Rahmenbedingungen und Muster von Frauenerwerbstätigkeit. Wichtige Unterschiede beziehen sich auf das Niveau und die Struktur wohlfahrtstaatlicher (Dienst-)Leistungen, die Lohnverteilung und -höhe, den Umfang und Anteil der Dienstleistungsbeschäftigung und – nicht zuletzt – unterschiedliche Frauenerwerbsquoten. La présente étude a pour but dévaluer lampleur des disparités régionales au sein de lUnion européenne. Grâce à des méthodes et des outils scientifiques de pointe permettant une analyse critique, elle présente des données empiriques sur la dynamique des disparités régionales et des problèmes de cohésion territoriale. Elle sappuie sur ces données pour proposer des moyens daborder la cohésion territoriale dun point de vue statistique et politique. Enfin, létude propose plusieurs méthodes destinées à combler les lacunes actuellement présentes dans les données territoriales disponibles ainsi que des recommandations concrètes concernant les moyens daméliorer la conception, la mise en oeuvre et le suivi de la politique de cohésion.[Parlement européen] | This study aims to assess the extent of regional disparities within the European Union. Using state-of-the-art scientific methodologies and tools enabling a critical analysis, it presents empirical evidence on the dynamics of regional disparities and territorial cohesion challenges. This study has been produced under the European Community Action Programme to combat discrimination (2001-2006). This programme was established by the European Commission's Directorate-General for Employment and Social Affairs as a pragmatic support to ensuring effective implementation of the two Directives on "Race" and "Equal treatment in the workplace" (2000) emanating from Article 13 of the Amsterdam Treaty. Title: Definition of disability
Abstract
This paper is about the issue of defining disability in European discrimination law context. It is based on the research and discussions which have been undertaken within the European Group of Disability Discrimination Experts. The paper reviews the definition of disability in disability discrimination laws of those EU countries1 which have transposed the Framework Directive 2000/78/EC by the end of 2003. The main question of this review is whether the various definitions of disability perpetuate the medical/individual model of disability or support the social model of disability. According to the medical/individual model of disability the problems disabled person face in their daily life are mainly caused by their impairment, whereas the social model locates the problems in societal and environmental barriers outside the individual disabled person. The paper examines whether impairment related definitions of disability in disability discrimination laws perpetuate the medical model of disability. Secondly, the paper discusses whether a definition of disability is necessary within the context of disability discrimination law. [Author vide copyright]

reconciling the principle of equal treatment and health and safety regulations under European Union law
Abstract
This Report presents a legal analysis of the coexistence between regulations seeking to protect health and safety at work and the requirement of non-discrimination in work and employment against persons with disabilities. Its asks whether health and safety regulations may constitute barriers to the employment of persons with disabilities, and, where such barriers exist, which legal responses they call for. It focuses especially on what the right to respect for private life and the rules protecting personal data may contribute to lowering such barriers. Drawing the consequences from the emergence of the principle of equal treatment with regard to persons with disabilities, and from the rise of the civil rights paradigm in disability law generally, it illustrates how the existing regulatory framework may be relied upon in order to effectuate the shift from a « fitness » approach to an «adaptation » approach in the regulation of preemployment inquiries and medical examinations. It insists in particular on the function of the obligation to provide an effective accommodation to persons with disabilities in alleviating the tension between regulations relating to health and safety at work and the prohibition of discrimination. The report is drawn up on the basis of detailed reports in respect of each of the countries surveyed, and a further five ('comparator') countries: Australia, Canada, New Zealand, South Africa and the United States of America. Sexual orientation as a concept is so far not recognised by Greek Law, which implicitly but systematically recognises, accepts, protects and institutionalises human sexuality that is confined within the limits of the traditional married heterosexual couple. Other forms of sexuality are either: totally ignored, disapproved or tolerated by the law. The absence of any anti-discrimination law (with the exception of gender, race or origin) and the general negative climate have obliged Greek citizens to deny and/or hide their true sexual identity. This report has been drafted as part of a study into measures to combat discrimination in the EU Member States, funded by the European Community Action Programme to combat discrimination.The present report was completed on March 1st, 2007, prior to the adoption of four legislative bills proposed by the government, and formally submitted to the House of Representatives on 26 October 2006. These bills were prepared in order both to overcome the difficulties created by the judgment n° 157/2004 delivered by the Constitutional Court (Court of Arbitration) on 6 October 2004 (partially annulling the Federal Antidiscrimination Law of 25 February 20031), and to meet the concerns expressed by the European Commission in its correspondance with the Belgian authorities about the state of implementation of the Racial Equality and Employment Equality Directives. Gender mainstreaming is an integral part of the research conducted by the European Foundation for the Improvement of Living and Working Conditions. When labour market participation, working conditions and the resulting labour market outcomes are analysed, the difference in the situation of women and men is evident. This report highlights the main issues concerning women's situation in the labour market and indicate where the principal barriers to women's labour market participation lie. [Author vide Copyright]
