Title: Illness, disability and social inclusion
Abstract
The development of policies and the delivery of services to promote the social inclusion of people with a chronic physical or mental illness or disability are crucial steps in achieving a more inclusive society. This report examines how to drive this process forward. It reviews the nature and scale of the problems facing different groups and identifies policy initiatives in employment, education, housing, transport and other areas which facilitate social and economic integration. Published to coincide with the European Year of People with Disabilities, the report aims to fuel the debate and increase policy focus on people with a chronic illness or disability, particularly those of working age. Title: Employment and disability: Back to work strategies
Abstract
This report examines social exclusion through illness, specifically the processes whereby people who develop chronic illnesses are excluded from the workforce. It proposes a new model for understanding the nature of this problem, it develops an assessment tool for new initiatives in the area and makes recommendations on how best to promote social inclusion for people with chronic illnesses. Title: Pre-employment inquiries and medical examinations as barriers to the employment of persons with disabilities:
reconciling the principle of equal treatment and health and safety regulations under European Union law
Abstract
This Report presents a legal analysis of the coexistence between regulations seeking to protect health and safety at work and the requirement of non-discrimination in work and employment against persons with disabilities. Its asks whether health and safety regulations may constitute barriers to the employment of persons with disabilities, and, where such barriers exist, which legal responses they call for. It focuses especially on what the right to respect for private life and the rules protecting personal data may contribute to lowering such barriers. Drawing the consequences from the emergence of the principle of equal treatment with regard to persons with disabilities, and from the rise of the civil rights paradigm in disability law generally, it illustrates how the existing regulatory framework may be relied upon in order to effectuate the shift from a « fitness » approach to an «adaptation » approach in the regulation of preemployment inquiries and medical examinations. It insists in particular on the function of the obligation to provide an effective accommodation to persons with disabilities in alleviating the tension between regulations relating to health and safety at work and the prohibition of discrimination. Title: Developing Anti-Discrimination Law in Europe : The 28 EU Member States, the Former Yugoslav Republic of Macedonia,
Iceland, Liechtenstein, Norway and Turkey compared
Abstract
Over 10 years ago a major and unprecedented evolution occurred in the European Union with the adoption in 2000 of two pieces of EU legislation in the field of anti-discrimination: the Racial Equality Directive (2000/43/EC) and the Employment Equality Directive (2000/78/EC). The transposition and implementation of these legal provisions into the national legal systems of the 28 Member States is described in a series of annually updated country reports produced by the European Network of Legal Experts in the Non-discrimination Field. In addition, the Network also includes candidate countries (the former Yugoslav Republic of Macedonia, Iceland and Turkey) and, since 2012, EEA countries (Liechtenstein and Norway). The Network annually reports on their national legislation compared with the anti-discrimination standards set by the EU. This Network was established and is managed by the Human European Consultancy and the Migration Policy Group. The national reports are written by independent national experts in each country covered by the Network. The information is provided in response to questions set out in a template format which closely follows the provisions of the two Directives, although all countries included in the Network do not have the same compliance obligations. The 33 reports cover national law, the establishment of enforcement mechanisms, jurisprudence and the adoption of other measures. They contain information current as of 1 January 2014. As such, they are a valuable source of information on national anti-discrimination law and can be found on the Network’s website at: www.non-discrimination.net. This Comparative Analysis, drafted by Isabelle Chopin and Catharina Germaine (Migration Policy Group), compares and analyses the information set out in the 2013 country reports in a format mirroring that of the country reports themselves and draws some conclusions from the information contained in them.
