Abstract
Die aktuelle sozialpolitische Agenda der Europäischen Union, die in der Mitteilung der Kommission vom Juni 2000 skizziert und im Dezember 2000 vom Europäischen Rat in Nizza verabschiedet wurde, erstreckt sich auf den Zeitraum bis 2005. Die nächste Sozialagenda umfasst den Zeitraum 2006-2010 und wird im Rahmen einer bisher beispiellosen und noch nicht abgeschlossenen Erweiterung umgesetzt werden. Die Hochrangige Gruppe1 wurde von der Kommission eingesetzt, um die wichtigsten Herausforderungen, Chancen und Handlungsmöglichkeiten für die Europäische Union im Bereich Beschäftigung und Sozialpolitik während des Zeitraums 2006-2010 zu benennen. Dabei verfolgte die Gruppe einen strategischen Ansatz und war bemüht, sozialpolitische Kerngedanken für das erweiterte Europa herauszuarbeiten und einige wichtige politische Orientierungslinien zu entwerfen. Title: Definition of disability
Abstract
This paper is about the issue of defining disability in European discrimination law context. It is based on the research and discussions which have been undertaken within the European Group of Disability Discrimination Experts. The paper reviews the definition of disability in disability discrimination laws of those EU countries1 which have transposed the Framework Directive 2000/78/EC by the end of 2003. The main question of this review is whether the various definitions of disability perpetuate the medical/individual model of disability or support the social model of disability. According to the medical/individual model of disability the problems disabled person face in their daily life are mainly caused by their impairment, whereas the social model locates the problems in societal and environmental barriers outside the individual disabled person. The paper examines whether impairment related definitions of disability in disability discrimination laws perpetuate the medical model of disability. Secondly, the paper discusses whether a definition of disability is necessary within the context of disability discrimination law. [Author vide copyright]

Title: Pre-employment inquiries and medical examinations as barriers to the employment of persons with disabilities:
reconciling the principle of equal treatment and health and safety regulations under European Union law
Abstract
This Report presents a legal analysis of the coexistence between regulations seeking to protect health and safety at work and the requirement of non-discrimination in work and employment against persons with disabilities. Its asks whether health and safety regulations may constitute barriers to the employment of persons with disabilities, and, where such barriers exist, which legal responses they call for. It focuses especially on what the right to respect for private life and the rules protecting personal data may contribute to lowering such barriers. Drawing the consequences from the emergence of the principle of equal treatment with regard to persons with disabilities, and from the rise of the civil rights paradigm in disability law generally, it illustrates how the existing regulatory framework may be relied upon in order to effectuate the shift from a « fitness » approach to an «adaptation » approach in the regulation of preemployment inquiries and medical examinations. It insists in particular on the function of the obligation to provide an effective accommodation to persons with disabilities in alleviating the tension between regulations relating to health and safety at work and the prohibition of discrimination. This study has been produced under the European Community Action Programme to combat discrimination (2001-2006). This programme was established by the European Commission's Directorate-General for Employment and Social Affairs as a pragmatic support to ensuring effective implementation of the two Directives on "Race" and "Equal treatment in the workplace" (2000) emanating from Article 13 of the Amsterdam Treaty. The six-year Programme primarily targets all stakeholders capable of exerting influence towards the development of appropriate and effective anti-discrimination legislation and policies, across the EU-25, EFTA and the EU candidate countries.
