Title: Migrants, minorities and education : Documenting discrimination and integration in 15 member states of the European
Union
Abstract
Foreword This study presents a unique collection of material on the situation of migrants and minorities in the European Union in the field of education. Covering the years 2001 to 2003, the study provides a comparative analysis of the state of integration, educational achievements and existing discrimination of minority pupils and students. The main focus of this study is on different forms of disadvantages and unequal treatment experienced by migrants and minorities in school, university and vocational education across the EU Member States. Besides this, an overview of good practices shows each country's efforts to improve the educational situation of these groups, e.g. by carrying out language programmes or offering inter-cultural training. The study finishes with selected recommendations to European Union institutions and Member States. School attainment and the quality of education have a decisive impact on the pupils' future employment opportunities. Unfortunately, evidence gathered in this study shows that despite numerous endeavours to improve the educational accomplishments of migrants and minorities, for the most part, their achievements lag behind that of the majority groups. However, in several countries young migrants of the second generation tend to perform better than their peers who arrived more recently. I hope that this report will raise public and official awareness on the issue of discrimination in the educational sector and will contribute to the creation of equal opportunities for all children and young people living in the EU. The data for this report was compiled for the EUMC by its RAXEN National Focal Points in each of the (at the time) 15 Member States. The EUMC then invited an independent researcher to bring this material together in the form of the current report. Abstract
FOREWORD The material in this report is a unique collection of evidence on employment disadvantage, discrimination and exclusion of migrants and ethnic minorities in 15 countries of the EU. It appears during the year when the two Council Directives - the Racial Equality Directive and the Employment Equality Directive - are due to be transposed into the legislation of Member States. The evidence of this report stands as a counter to anyone who until now considered the Equality Directives to be unnecessary, by documenting incidents and types of employment discrimination across the EU, and providing an insight into the processes of exclusion. It also highlights examples of 'good practices' in the area, carried out by governments, employers, trade unions, NGOs and migrant organisations, and finishes with selected recommendations for the EU and its Member States. Tackling discrimination at work is important, not only for reasons of social cohesion and social justice, but also because it makes good business sense, and now, increasingly, because the law will require it. European employers are increasingly realising that discrimination is bad for business. It leads to low morale and motivation, lower productivity, workplace tensions, higher labour turnover, and difficulties in recruitment. On the other hand, the benefits of diversity and a properly managed diverse workforce are also clear, with companies more able to take advantage of newly varied markets and provide better and more culturally-sensitive products and services. In June 2003 the European Commission launched a new campaign aimed at raising awareness of discrimination in Europe. I hope that this report will contribute to this process, and play its part in helping to heighten public and official awareness on issues of discrimination in the employment sector. Abstract
Foreword This study comprises a unique collection of material on anti-discrimination legislation and case law in the European Union in 2003. Referring to the year when the EU Council Directive on Racial Equality (along with the Employment Equality Directive) was due to be transposed, this study presents a comparative analysis of existing and developing legal measures and remedies against discrimination of migrants and ethnic minorities. Thus, this study focuses on how different Member States approach the implementation of the Racial Equality Directive by either adapting current legislation or establishing new separate laws. On the other hand, an overview of existing non-discrimination legislation across the EU shows up to which degree anti-discrimination, anti-racism or general equality provisions have already been part of the Member States' constitutions or specific laws. In addition, the study also highlights exemplary court cases and complaints concerning discrimination, and finishes with selected recommendations for the EU and its Member States. Legislation-be it civil, administrative or penal law-builds the foundation of every action and policy against discrimination. In transposing the Council Directives 2000/43/EC and 2000/78/EC Member States use a variety of methods, legal provisions and legal wording. Whereas some countries' status quo has demanded only minor amendments to comply with the Directives, it is clear that in countries lacking a history of strong anti-discrimination legislation the two Directives have induced a major positive change. I hope that this report, which also identifies existing shortcomings and areas of problems, will contribute to this encouraging process. The data for this report was compiled for the EUMC by its RAXEN National Focal Points in each of the (at the time) 15 Member States. The EUMC then invited the International Centre for Migration Policy Development in Vienna (ICMPD) to bring this material together in the form of the current report.
