Abstract
In the aftermath of the financial crises, questions have been raised as to why there were significant differences in the denominator of the calculation of risk-weighted assets (RWAs). The EBA and other international bodies have already conducted significant work on the comparability of capital requirements for the Internal Ratings-Based Approach (IRBA) and the Internal Market risk Models, leading to a greater understanding of the consistency of risk-weighted assets .European legislators have acknowledged the need to constrain the inconsistent calculation of risk-weighted assets for equivalent portfolios and the revised Capital Requirements Regulation and Directive (‘CRR’ and ‘CRD’, respectively) now include a number of mandates for the EBA to deliver technical standards, guidelines and reports aimed at reducing uncertainty and differences in the calculation of capital requirements.In this regard, article 78 of the CRD requires that, at least annually, competent authorities assess the consistency and comparability in risk-weighted assets (RWA) produced by institutions’ internal modelling approaches (except for operational risk) for which competent authorities have granted permission to be used for capital purposes.The draft implementing technical standards (ITS) specify the benchmarking portfolios as well as the templates, definitions and IT solutions that should be applied in the benchmarking exercise for market and credit risk.The draft regulatory technical standards (RTS) specify the procedures for sharing the assessments between the competent authorities and with the EBA and the standards for the assessment by competent authorities of the internal approaches applied to calculating own funds for market, IMM, CVA and credit risk.[Author vide Copyright]

Title: Guidelines on disclosure of indicators of global systemic importance
Abstract
Pursuant to Article 131(1) of Directive 2013/36/EU (‘the Directive’), competent or designated authorities in the Member States shall identify European banks that represent a higher risk to the global financial system as Global systemically important institutions (G-SIIs).Article 441 of Regulation (EU) No 575/2013 (the ‘Regulation’) requires G-SIIs to make public the values used for the identification and scoring process in accordance with certain uniform formats and dates specified in the draft ITS. To ensure a transparent identification process and a level playing field, especially prior to the identification of any G SIIs, and to enable Member States’ authorities to inform themselves about the data of banks authorised in other Member States in the identification process, pursuant to these Guidelines other large entities with an overall exposure exceeding EUR 200 billion, which fall into the scope of Article 131(1) of Directive 2013/36/EU and are potentially systemically important, will also be subject to the same disclosure requirement.In addition, the Guidelines contain detailed instructions for each of the data points included in the template.[Author vide Copyright]

Title: EBA final draft regulatory technical standards on the methodology for the identification of global systemically
important institutions (G-SIIs) under Article 131 of Directive 2013/36/EU
Abstract
Pursuant to Article 131(1) of Directive 2013/36/EU (‘the Directive’), competent or designated authorities in the Member States will identify European banks representing a higher risk to the global financial system as Global systemically important institutions (G-SIIs). For G-SIIs, higher own funds requirements will apply depending on their systemic relevance, according to which they will be allocated to sub-categories (‘buckets’). Whilst the Directive outlines certain basic principles of the methodology for identifying G-SIIs and allocating them to subcategories, Article 131(18) sets out a mandate for the present draft RTS to specify this methodology further.The Directive and these draft RTS require Member States’ authorities to take into account internationally agreed standards for the identification of systemically important institutions. In particular, this means the framework for global systemically important financial institutions established by the Financial Stability Board and developed by the Basel Committee on Banking Supervision (BCBS). The Directive and the further specification of the methodology are designed so that data reported by EU and non-EU banks for the BCBS identification process can also be used for identification pursuant to the Directive. Member States’ authorities should ensure that the data are identical to those used by the BCBS.Every year, Member States’ authorities will calculate a score for each bank to measure its systemic significance. The Directive defines five categories of indicators to be used in this scoring process and these draft RTS specify 12 (sub)-indicators that fall into these categories. In addition, authorities are required to apply the same parameters for calculation and allocation to subcategories: for each year, ‘denominators’ calculated on the basis of indicator data taken from a sample of large EU and non-EU banks to normalise the indicator values and make the scores comparable, and cut-off scores between the subcategories.The indicators are designed to reflect

Title: EBA final draft implementing thechnical standards on disclosure of the leverage ratio under Article 451(2) of Regulation

Abstract
The Capital Requirements Regulation (‘CRR’) and the Capital Requirements Directive (‘CRD IV’) texts specify the calculation of the leverage ratio, the reporting of which has been applicable from 1 January 2014. In addition to supervisory reporting, Article 451(1) of the CRR requires institutions to disclose information on the leverage ratio. In accordance with point (2)(a) of Article 521(1) of the CRR, disclosure will be applicable from 1 January 2015. To harmonise disclosure, Article 451(2) of the CRR contains a mandate for the EBA to develop draft implementing technical standards (ITS). Against this backdrop, these draft ITS contain a uniform template and instructions for the disclosure of leverage ratio and its components.The European Commission has been empowered to enact a delegated act to change the calculation of the leverage ratio (Article 456(1)(j) of the CRR) before disclosure begins as of 1 January 2015. For this reason, the ITS in general, and the templates and instructions in particular, will be subject to future changes depending on the decisions made in the delegated act. A number of aspects, including the frequency of disclosure, are not included in the mandate given to the EBA. For some of these aspects, the EBA has been given the mandate to provide an evaluation in the impact report that is due by 31 October 2016 (Article 511(3)(h) of the CRR).[Author vide Copyright]

Title: Joint Committee Final Report on guidelines for complaints-handling for the securities (ESMA) and banking (EBA) sectors
Abstract
The European Securities and Markets Authority (ESMA) and the European Banking Authority (EBA) published today their Joint Committee final Report on guidelines for handling consumer complaints in the securities and banking sectors. The document aims to increase market confidence and for the benefit of consumers and firms alike it will ensure a harmonised approach to handling complaints for all 28 EU Member States and across all financial services sectors.The final report published today is part of the efforts of the European Supervisory Authorities to bring further supervisory convergence across the securities and banking sectors. It was developed on the basis of the existing complaints-handling guidelines established by EIOPA (the European Insurance and Occupational Pensions Authority) for the insurance sector. The report was launched for a public consultation last year and this final version takes into consideration the feedback received.ESMA and the EBA consider that these guidelines will ensure a consistent approach to complaints-handling across the EU. Consumers can purchase financial services and products in the investment, banking and insurance sectors across the entire EU Single Market and these guidelines will allow them to refer to a single set of complaints-handling arrangements. EU consumers will therefore be able to rely on the same approach irrespective of what type of product they have purchased and where they have purchased it.In addition to strengthening consumer protection -a key statutory objective for ESMA and for the EBA-, the guidelines will also allow firms, some of which sell products from more than one sector across the EU, to streamline and standardise their own complaints-handling arrangements. National regulators too will be able to supervise the same harmonised requirements across all sectors of financial services in their own jurisdictions.[European Securities and Markets Authority]
