Abstract
The following report intents to describe the matrimonial property law in Austria. Austrian matrimonial property law to a large extent is settled law. Although very important for marriage this area of law compared to marriage and divorce law is of less interest to legal literature. Only recently and due to European law as well as to partly fundamental changes in society possible changes are discussed. The authors when drafting this report used the most recent literature. Historical aspects are mentioned only where necessary for the overall understanding. Important court decisions as well as further reading are referred to in the footnotes. [Walter Rechberger]

Abstract

Abstract
The object of this report is to present an outline on the central features of the private international law rules relating to matrimonial property in England and Wales. In the United Kingdom there are several distinct legal systems: England and Wales, (one legal territory, referred to hereafter simply as England), Scotland, Northern Island and the Channel Islands. While the laws of Northern Island and the Channel Islands are basically not dissimilar from English law, the law of Scotland is markedly different. This report only covers the laws of England. The report follows the general scheme suggested in the directions to National Experts. However, as there are no primary and secondary property regimes in England, some adaptation of the suggested scheme has been necessary. [Author vide Copyright]

Abstract
This report is made with the aim to lay out the general structure of the Finnish legislation concerning marriage and other kind of partnerships relevant from the point of view of law and legal institutions. The method used is the classical method of jurisprudence: an analysis based on legal norms, law literature, and case law of the Supreme Court. The questionnaire has been followed as closely as possible, thus aiming to facilitate the demanding task of an union-wide comparison of the topic. As to the recent Finnish law amendments of private international regulation, there are no literature sources or case law to refer to. Thus the report is made on the basis of the laws as such and the Government Bills to the Parliament. [Eva Gottbberg]

Abstract
This is the National Report on German Law regarding property relations in social unions, like marriage, other legally acknowledged unions, and de-facto unions. It covers heterosexual and same-sex unions. Although the special focus of the report is on international relations (international jurisdiction and recognition of foreign acts; private international law), the substantive law of matrimonial property and property relations in similar unions will be discussed, too, in order to give a better understanding of the rules and problems of German law in the international context. This will also facilitate the comparison between different national laws in Europe, and allow the identification of common problems as well as national peculiarities. It will be shown that the changes that were caused by the rise of the principle of equality between husband and wife are nearly completed now, while new problems are caused by the rise and legal acceptance or even regulation of non-marital unions. The legal developments in other countries will be taken into account insofar as they may affect the operation of German private international law.
