Title: Progress and Obstacles in the Area of Justice and Home Affairs in an Enlarging Europe
Abstract
This paper assesses the legislative achievements made so far in the objectives set by the Amsterdam Treaty and the Tampere European Council. It explores why a number of Justice and Home Affairs (JHA) policy areas have experienced a greater degree of development or convergence than others. The road to establish a genuine area of freedom, security and justice (AFSJ) is still a long one. The widely held view of these issues as matters of national sovereignty continues to create obstacles to progress in this area. The legislative progress attained so far shows the difficulties of arriving at European policies on, immigration and asylum, as well as the rights of third-country nationals. A low level of convergence and progress towards issues related to freedom in these three areas can be appreciated by looking at the progress of the Tampere scoreboard. Higher levels of trust, flexibility, co-ordination and efficiency, in terms of cost and rapidity of response, are required to overcome these tensions. The right balance between freedom, security and justice needs to be ensured. Security and law enforcement policies need to be developed with freedom as the point of departure. A danger of the aftermath of the 11 September 2001 terrorist attacks and the current preoccupation with undocumented / illegal immigration is that a pattern may be established that leads to overly zealous security policies for European society, with adverse effects on the internal cohesion of Europe. In particular, certain minority groups may feel that they are subject to excessive attention by security forces. In addition, it is also perceived that the terrorist attacks in the USA have radically changed perceptions of security in the EU. Undoubtedly, these attacks have provided a new impetus for the development of the AFSJ. Abstract
Security research has constituted, over the pas few years, a strong priority for Community policies in the field of scientific research, industry, and justice and home affairs. Community efforts in this domain have been channelled, over the period 2002-2006, through the 6th Framework programme (FP6) and the Preparatory action on security research (PASR). FP6 has sustained, within its various thematic priorities, a series of projects and programmes dealing with technological developments in the field of security. The PASR is a targeted initiative of the European Commission aiming at developing contacts and partnerships between the actors of the European security industry, the public actors, and research bodies. PASR activities, in this respect, have mainly focused on technological development and the networking of actors, in anticipation for the thematic programme on security now established under FP7. The analysis of the contents of research being conducted under the FP6 and PASR is very revealing in this respect: it highlights the fact that this research is mainly oriented towards technological development as such, and unquestioningly takes security as a norm and a fundamental value. In this regard, and despite the odd exception, European security research does not include in its scope the effects that increasingly sophisticated technologies of control and surveillance can have on individual freedom and rights, particularly with regard privacy and the protection of personal data. It does not address the necessary limits to security. The point, then, is to envisage the modalities through which a reflection on the ethical, legal, political and social implications of security technologies can be strengthen and further integrated in European security research.[European Parliament] | La recherche en matière de sécurité constitue, depuis quelques années, une priorité affichée dans le domaine des politiques communautaire, quil sagisse des politiques scientifiques, industrielles, ou de justice et affaires intérieures. Sur la période 2002-2006, le 6e Programme cadre de recherche et de développement (PCRD) et lAction préparatoire en matière de recherche sur la sécurité (PASR) constituent les deux principaux appuis communautaires dans ce domaine. Le 6e PCRD a soutenu, dans le cadre de ses différentes priorités thématiques, une série de projets et de programmes portant sur le développement technologique en matière de sécurité. La PASR est une initiative spécifique initiée par la Commission européenne pour développer les contacts et les partenariats entre les acteurs de lindustrie de sécurité européenne et les acteurs publics. Les activités de la PASR, à ce titre, ont majoritairement porté sur le développement technologique et la mise en place de réseaux dacteurs, dans la perspective du programme thématique sur la sécurité aujourdhui établi sous le 7e PCRD. Si lon analyse les contenus des recherches menées dans le cadre du 6e PCRD et de la PASR, il ressort de manière frappante que ceux-ci sont majoritairement orientés vers le développement technologique en tant que tel, et considèrent la sécurité comme une norme et une valeur fondamentale. Ce faisant, et à quelques exceptions près, la recherche européenne en matière de sécurité ninclut pas dans ses préoccupations les effets que des technologies de plus en plus sophistiquées en matière de contrôle et de surveillance peuvent avoir sur les libertés et les droits individuels, tout particulièrement en ce qui concerne la confidentialité et la protection des données personnelles. Elle nanalyse pas les nécessaires limites à la sécurité. Abstract
This evaluation assesses the relevance, efficiency, effectiveness, impact and sustainability of the European Commission’s support to its partner countries in the energy sector. It covers interventions designed or implemented during the 1996-2007 period in all the external cooperation partner countries. This scope of the evaluation is extremely broad and heterogeneous for three major reasons.First, the European Commission’s communications analysis shows that the Commission’s interventions in the energy sector have aimed to contribute to three very different goals: - Improving access to energy in developing countries as a means of reducing poverty; - Securing energy supplies to the EU; - Improving nuclear safety in the Former Soviet Union (FSU).The first goal is increasingly perceived as an important dimension of the fight against poverty; the two others address vital stakes for European citizens. Ranking these different goals by order of importance has no real meaning. Title: Implementation of the European Arrest Warrant and Joint Investigation Teams at EU and National Level
Abstract
The European Arrest Warrant and Joint Investigation Teams are two instruments of cooperation in the field of EU Freedom, Security and Justice. They are both currently used by Member States, but to different extents. The 2002 Council Framework Decision adopting the European Arrest Warrant has been challenged by national courts up to the constitutional level. Member States have also regularly implemented the European Arrest Warrant in contradiction with the text of the Framework Decision. Nevertheless, the European Arrest Warrant is the success story of EU judicial cooperation in criminal matters. Joint Investigation Teams, on the other hand, have been used much less by Member States. Additionally, the main EU legal basis has not yet been implemented in all Member States. Nonetheless, Joint Investigation Teams have demonstrated their usefulness in investigating the most serious forms of criminality. Both instruments could be used more efficiently, in particular through a stronger involvement of both Europol and Eurojust.[European Parliament]

Title: A Coherent EU Strategy for the Sahel

Abstract
The Sahel region constitutes Europe’s southern geopolitical border. Any instability there will eventually find its way into the European neighbourhood and Europe itself. The present study examines the main challenges affecting the region and offers a critical evaluation of the 2011 EU ‘Strategy for Security and Development in the Sahel’. The strategy identifies the lack of governmental capacity and systemic poverty as the key challenges the region faces and rightly points to concerted action in the security and development domains as the way forward. As such, we take a generally positive view of the diagnosis and the lines of action it envisages. However, we argue that one year after its adoption, the EU’s Sahel strategy has not lived up to expectations. For all the praising about the need for comprehensiveness, the EU’s efforts in the realm of security and development remain significantly disconnected. But ultimately, it is national caveats that pose the greatest threat to a more political implementation of the Sahel strategy. These include a denial of the strategic importance of the region, a lack of willingness to engage with Algeria and a resistance to incorporating military assistance into the EU’s toolbox. ESMA is calling for public feedback on possible content to draft technical standards on matters such as settlement discipline, CSD registration and requirements, including confirmation rules (acceptance or rejection of terms in good time before the intended settlement date) for trading venues and investment firms, as well as access to CSDs by other CSDs, participants and other market infrastructures.ESMA has a mandate to draft technical standards on more than 30 aspects under CSDR.ESMA will consider all comments received by 22 May 2014.A public hearing will take place on April 14th at ESMA in Paris, from 13h30 to 17h.As provided for by the ESMA Regulation, a full public consultation will be conducted on the draft technical standards before they are submitted to the European Commission (EC). Therefore, following this DP and on the basis of the relevant input received, ESMA will finalise its proposed draft technical standards, that will be included in a consultation paper. The date of publication of such a consultation paper and the commenting period will depend on the date of publication of the CSDR in the Official Journal and the final deadline for ESMA to deliver the draft RTS and ITS to the EC.[Author vide Copyright]
