Das Gutachten kann hierbei nur Anregungen geben, deren technische Umsetzung im einzelnen auszuarbeiten wäre. Es ersetzt nicht eine angesichts der Bedeutung dieser umfassenden Regulierung notwendige eingehende Arbeit auf der Grundlage der aktuellen Diskussion sowie der Kenntnis des umfassenden Regelungsbestandes in den Mitgliedsländern, für die allerdings weder Zeit noch Mittel vorhanden waren. Title: Misleading practices of ?directory companies? in the context of current and future internal market legislation aimed at
the protection of consumers and SMEs
Abstract
Executive summary This study by Civic Consulting provides an overview of the extent of the problem of directory companies reported to apply misleading practices. It describes judicial and nonjudicial measures taken by affected enterprises and discusses initiatives by Member States aimed at tackling these practices. The study further presents an overview of the current EU legal framework and its national implementation. Finally, the study presents overall conclusions with a discussion of options for EU-level action. The analysis of this study has been based on several resources. Stakeholders and competent authorities have been involved throughout the process of the data analysis by means of interviews and surveys. Several case studies were carried out for the report to document court cases and actions taken against directory companies reported to apply misleading practices. A detailed legal analysis for three Member States was carried out (for Austria, the Netherlands and Spain). The country reports examine the transposition of the Directive concerning Misleading and Comparative Advertising and the Unfair Commercial Practices Directive into national legislation, and possible resulting loopholes, as well as jurisprudence and other measures taken by the respective Member States. Abstract
Online hotel reservation systems are increasing in importance and greatly facilitate cross-border consumer activity. The Internet has enabled hotels to contract directly with a huge number of potential customers. It has also revitalised the role of agents and lead to a new type of agent, the web agent or travel gate, selling a far wider range of accommodation on behalf of a far wider range of hotels. However, while online booking has increased the range of offers available, there are also some emerging worries due to examples of unfair commercial practices and lack of transparency related to such reservations. Furthermore, it identifies those provisions of the CFR which could be used when amending the Proposal for a Consumer Rights Directive in the framework of the legislative procedure. In this regard, the study suggests some amendments based on the CFR. Title: Discrimination of Consumers in the Digital Single Market
Abstract
The study collates information on discrimination against consumers on grounds of place of residence or nationality in the Digital Single Market (DSM). Collected evidence indicates such practices as refusals to sell or discriminatory conditions depriving consumers of access to goods and services on DSM or obliging consumers to pay higher prices. The study assesses discrimination from the perspective of different areas of European law including Article 20 (2) of Services Directive, Private International Law, Competition Law and Intellectual Property Law, and provides for policy recommendations. Title: Placement of financial instruments with depositors, retail investors and policy holders ("self placement") : reminder to
credit institutions and insurance undertakings about applicable regulatory requirements
Abstract
As part of their respective mandates to protect investors, depositors and policy holders, the three European Supervisory Authorities, the EBA, ESMA and EIOPA are concerned about the practices used by some financial institutions to comply with enhanced prudential requirements under the CRD/R IV, the pending BRRD, and Solvency 2, as well as the ongoing EBA stress test and the ECB’s comprehensive assessment. These practices include financial institutions selling to their own client base financial instruments that they themselves have issued and that are eligible to comply with the above requirements. This practice may breach a number of rules governing the conduct of these institutions.However, the ‘loss bearing’ features of many of these products mean that consumers are exposed to significant risks that do not exist for other financial instruments. For example, investors are more likely to be subject to bail-in; and the absence of harmonised structures, trigger points and loss absorption makes it difficult for investors to understand and compare the products. Each product needs to be assessed as a unique offering, which may be particularly challenging for retail investors.The three authorities, within their remits, are reminding financial institutions that capitalisation pressures should not affect their ability to comply with existing and future requirements applicable in the European Union for the provision of services to consumers, including investors, depositors and policy holders. It is expected that due to regulatory and market developments, the risks of consumer detriment described here will further increase; this reminder is aimed at preventing this.[Author vide Copyright]
